Congresswoman Boebert Submits Public Comments in Opposition to IRS Taxing TABOR Refunds

October 17, 2023

Congresswoman Lauren Boebert and the bipartisan congressional Colorado delegation submitted a public comment letter to the Internal Revenue Service (IRS), urging the IRS to follow a 30-year precedent, and not tax TABOR refunds.

Congresswoman Lauren Boebert (CO-03) said, “The bipartisan Colorado delegation and I once again called on the IRS not to tax TABOR refunds. TABOR has been a fundamental part of Colorado's Constitution since 1992. Seeking to impose new taxes on refunds after more than three decades is reckless and greedy. TABOR refunds should never be treated as part of an individual's federal gross income and, as a result, should not be subject to taxation.”

Background:

Congresswoman Boebert and the Colorado Congressional delegation have been very vocal about excluding Coloradans' Taxpayer's Bill of Rights (TABOR) refundsfrom taxation. This is the third letter signed by Congresswoman Boebert to prevent TABOR refunds from being taxed.

Coloradans should not be burdened with  new taxes after enjoying 30 years of non-taxation for these refunds. With over half of Americans already living paycheck-to-paycheck, it is not the time to impose further financial strain on those already grappling with financial difficulties.
